 Purposes and legal basis of data processing

The main purpose of the data collected on our forms is recruitment and customer relations. It may also be used for statistical or analysis purposes.

The Publisher collects and processes data only with your consent. Mandatory information for the management of your file is preceded by * (other information is optional and has no impact on the processing of your file).

No decision having legal effects for Users is taken by exclusively automated processing.

Furthermore, the processing of personal data collected via the Application will be carried out by the Publisher in compliance with the principles set out in Data Recipients.

User data is intended for authorized persons of the Publisher and of any company belonging to the SAMSIC Group within the meaning of the provisions of Articles L.233-3 and L.233-16 of the French Commercial Code in France and abroad, as well as, in part, for companies interested in the profile of Candidate Users.

It may also be shared in a legal and secure manner with third parties who help us to improve our solutions and services, as well as with providers of sector-based surveys, training and social action organizations, who are subject to a duty of confidentiality.

The SAMSIC Group undertakes not to pass on or distribute your data to other third parties for commercial prospecting purposes.

The SAMSIC Group may communicate your data to legal authorities if required to do so by law.

 

Rights concerning data

In accordance with legislation on the protection of personal data, Users have the right to access, rectify, delete and port their data and to oppose or limit the processing of their data. To exercise these rights, Users may contact the Publisher by post at the following address

For security reasons and to avoid fraudulent requests, this request must be accompanied by proof of identity. Once the request has been processed, the proof of identity will be destroyed.

The Publisher reminds Users that they may withdraw their consent to the processing of their data by the SAMSIC Group at any time and without giving any reason.

The User may at any time refuse to receive any communication by e-mail.

The User may also lodge a complaint with the Commission Nationale de l'Informatique et des Libertés.

 Security

The Publisher has implemented appropriate technical and organizational measures designed to protect Users' personal data against accidental loss or unauthorized access, use, alteration or distribution. Despite these measures, the Internet remains an open system and the Publisher cannot guarantee that unauthorized third parties will not be able to circumvent the measures in question or use personal data for illegitimate purposes.

 

 Article 2 - Access to the Application

 Access to the Site is reserved for adults or the legal representatives of minors with parental authority. The Publisher reserves the right to request proof of age. 

Access to and use of the Application is for strictly personal use only. You undertake not to use the Application and the information or data contained therein for commercial, political or advertising purposes or for any form of commercial solicitation, in particular the sending of unsolicited e-mails.

You acknowledge that you have the necessary computer equipment, including an Internet browser, and the necessary connection to access the Site in accordance with the specifications set out below:

Article 3 - Intellectual property - Content protection

 All trademarks, photographs, texts, comments, illustrations, images (animated or not), video sequences, sounds, as well as all computer applications that may be used to operate the Supports and, more generally, all elements reproduced or used on the Supports are protected by current intellectual property laws.

They are the full and complete property of the Publisher and/or of all companies belonging to the SAMSIC Group or of its partners, contractors or suppliers. Any reproduction, representation, use or adaptation, in any form whatsoever, of all or part of these elements, including computer applications, without the prior written consent of the Publisher or the holder of the rights is strictly forbidden, with the exception of downloading, displaying and printing for private non-commercial purposes.  

The User may only use the Application to access the Services, and exclusively for private, non-commercial purposes.

In particular, it is expressly recognized and accepted by the User that the use of automated systems or software to extract data from the Application, in particular any content contained therein (screen captures, screen scraping, web scraping, without this list being exhaustive), for any purpose whatsoever, whether commercial or non-commercial, is strictly prohibited, unless a license agreement has been concluded with the Publisher or any rights holder. The fact that the Publisher does not initiate proceedings as soon as it becomes aware of such unauthorized use does not imply acceptance of said use and waiver of prosecution.

In accordance with the provisions of Article L.122-4 of the French Intellectual Property Code, any representation, reproduction, extraction, or exploitation not expressly authorized by the Publisher or the holder of the rights, in whole or in part, free of charge or against payment, and by any process whatsoever of at least one element of the Application, shall be unlawful and shall constitute an infringement punishable by articles L.335-2 et seq. of the French Intellectual Property Code.


 Article 4 - Liability

The Publisher, its legal representatives, directors and/or employees, may not be held liable for any damage whatsoever arising from connection to and/or use of the Application and/or any Services.

 Hardware/connection data

The equipment you use to connect to the Application is your sole responsibility. You must take all appropriate measures to protect your equipment and your own data, in particular from virus attacks via the Internet. You are also solely responsible for the sites, applications and data you consult.

The User is responsible for the browser he/she uses to access the Application and Services. It is the User's responsibility to ensure (i) that the configuration of their operating system and the browser they use is secure and (ii) that their browser's cache memory has been cleared so that the pages accessible are up to date.

The Publisher automatically holds certain data concerning Users of the Application, such as the Internet Protocol (IP) address of your computer, the IP address of your Internet service provider, the date and time you access the Application, the Internet address of the website from which you are redirected to the Application, the operating system you are using, the pages you access, and the information you post or download from the Application. This data may be used for system administration and to improve the Services, in compliance with the provisions of article 5 of the GCU relating to the protection of privacy and respect for personal data.

 Confidentiality of identifiers and access codes

The Publisher and/or its legal representatives, managers and/or employees may not be held liable for any damage whatsoever arising from connection to and/or use of the Application and/or any Services.

In order to use certain Services, the Publisher may provide you with the identifiers and access codes required to connect to said service. Similarly, in accordance with Article 4, you choose your login details when you create your Account. These identifiers are strictly personal, non-transferable and confidential, and are your responsibility. Please ensure that you do not pass on these identifiers to third parties, in order to preserve the confidentiality of the professional and personal data you have transmitted to us, as well as the information accessible via the service.

All access to and use of the Services, as well as all operations carried out via the Services, using a Candidate User's login and password, will be deemed to have been carried out by the Candidate User himself/herself. Consequently, the User Applicant undertakes not to transfer or communicate to any third party his/her login details. The User-Candidate remains solely responsible for the use of these identifiers and undertakes to take all necessary measures to ensure and preserve their confidentiality.

In the event that the Editor has reason to believe that identifiers have been misused or used improperly, and more generally in order to ensure the security of the Application, the Editor reserves the right, at any time, without prior notice or formality and without this giving rise to any right to compensation for any prejudice, in particular loss of profit, business or opportunity, to suspend and/or delete any identifier, or even any access to the Application. It shall be the responsibility of the Publisher to inform the Candidate User concerned by the misuse of his/her login and password of the consequences of the use of his/her Account.

Without prejudice to the foregoing, you undertake to inform the Publisher without delay of any unauthorized use of your identifiers by a third party of which you become aware, and of the circumstances leading to such use. In addition, you agree to cooperate actively with the Editor to put an end to such unauthorized use.

the Editor shall not be held responsible for the use of the Services by a third party in possession of a Candidate User's Account identifiers.

 Application content

The information and data made available on the Application are provided for information purposes only and in no way constitute legal and/or operational advice, nor engage the responsibility of the Publisher.

You are reminded of the risks inherent in the electronic transmission of information. Delays, omissions or inaccuracies may occur. The information accessible via the Application is provided as is, regardless of its source.

The Publisher reserves the right to remove any content published by you on the Application which, in its sole judgment, may infringe any right of a third party.

The Editor may not be held liable in the event of legal proceedings against you :

- as a result of your use of the Application or any service accessible via the Internet ;

- as a result of your failure to comply with the GCU.

The Editor is not responsible for any damage caused to you, to third parties and/or to your equipment as a result of your connection to or use of the Application, and you hereby waive any claim against the Editor in this respect.

Should the Editor be the subject of legal or amicable proceedings arising from your use or misuse of the Application, he may take action against you to obtain compensation for all damages, sums, fines and costs that may arise from such proceedings.

Confidentiality of communications via the Internet and other networks

The Editor does not guarantee the User the security of the transmission of information, data or documents of any kind between the Editor and the Candidate User. The Publisher is not responsible for any interception, hacking or theft of said information by a third party during transmission.

Availability

The Application is, in principle, accessible 24 hours a day, 7 days a week, except in the event of scheduled or unscheduled interruption for maintenance, updating or in cases of force majeure. As the Publisher is subject to an obligation of means, it cannot be held responsible for any damage whatsoever resulting from the unavailability of the Application.

 Proof, storage and archiving

The User and the Publisher acknowledge, by way of a proof agreement between them in accordance with the provisions of Article 1316-2 of the French Civil Code, that the computerized registers kept in the Publisher's systems in compliance with the state of the art in terms of security, will be considered as proof with probative force of e-mail communications, registration form submissions, document downloads, acceptances, service subscriptions and order placement. Such information and documents shall be archived on a medium capable of ensuring the integrity and faithful and durable nature required by the legal provisions in force. It is agreed that in the event of any discrepancy between the computerized records held by the Publisher and any documents in whatever format (paper, electronic or other) available to you, the Publisher's computerized records shall prevail.

The archiving and conservation of dematerialized documents appearing in the Digital Safe is ensured by Primobox and is not the responsibility of the Publisher.

 

 Article 5 - Hypertext links

 The setting up by you of any hypertext links to all or part of the Application is strictly forbidden, unless prior written authorization has been obtained from the Publisher, requested by e-mail with acknowledgement of receipt to the following address:

The Publisher is free to refuse this authorization without having to justify its decision in any way whatsoever. Should the Publisher grant its authorization, it is specific and in all cases only temporary, and may be withdrawn at any time, without any obligation on the part of the Publisher to justify its decision.

In all cases, any link must be withdrawn by simple request to the Editor.

Any information accessible on the Application via a link to other sites or Applications is not under the control of the Editor, who declines all responsibility for their content.

 

Article 6 - Cookies - Usage policy

 The User is hereby informed that when accessing and using the Application, information is temporarily stored in memory or on the User's hard disk, notably by means of cookies.

The Publisher's policy on the use of cookies is detailed below.

The User is informed of this cookie policy by clicking on the information box provided for this purpose, which is displayed whenever the User connects to the Application. The User is then directed to the file containing the present GTU, which contains the policy on the use of cookies.

 Photographs and representations of any kind appearing on the Application associated with the Services, accompanying their description, are not contractual and do not bind the Publisher.

  Article 8 - Applicable law

 The GCU are written in French, which is the language in which they are interpreted.

The GCU are governed by French law and are subject to the jurisdiction of the courts of RENNES, subject to a specific attribution of jurisdiction arising from a particular legal or regulatory text.
